Terms of Use

1. DEFINITIONS

  • "App": The ‘Dude, Where’s My Stuff? By Cadence Sports (‘Cadence’) is an asset management platform, including backend services, used for locating, tracking, and managing passengers and assets. and does not provide transportation service.
  • "Assets": Passengers, Bikes, bicycles, luggage, bags, and related items tracked via the App.
  • "Administrator/Staff": User responsible for assigning tasks, monitoring asset locations, and managing driver activities.
  • "Driver": User responsible for transporting passengers and assets and providing location updates through the app.

2. USER ACCOUNTS & REQUIREMENTS

  • Eligibility: You must be at least 18 years of age.
  • Accuracy: All Users must provide accurate, current, and complete information during registration.
  • Account Security: You are responsible for safeguarding your password and account. You agree not to disclose your password to any third party.
  • Account Types:
    • Administrator/Staff: Authorized to scan in-out passengers and assets, view real-time data of assigned Drivers and passengers/assets.
    • Driver: Authorized to provide location data, status updates, scan in-out, and transport passengers and assets.
  • No Sharing: Accounts are personal and may not be shared or transferred.

3. SMS PROGRAM

By opting in during event registration, you agree to receive text messages from the "Dude, Where's My Stuff?" app by Cadence Sports about the transport and delivery status of your bike during an event (for example: Loaded, In Transit, Arrived). Message frequency varies, generally 3 messages per event. Message and data rates may apply. Reply STOP to unsubscribe at any time, or HELP for help. 4. USAGE & CONDUCT

  • Permitted Use: The App is provided solely for tracking and managing passenger/asset transportation.
  • Driver Responsibilities: 
    • Drivers agree to keep the App active during transportation, provide accurate location data, and report asset status promptly.
    • All drivers operating the app are strictly prohibited from holding, supporting, or manually operating any mobile electronic device
    • If a driver must make or receive a call, use SMS/text, or use the app in any way while their vehicle is in motion, they must use an approved hands-free accessory. This includes built-in vehicle Bluetooth systems, Bluetooth earpieces, or a properly mounted phone holder/cradle on the dashboard or windshield. The device must be positioned in a manner that does not impede the view of the road.
    • Drivers may only touch the device to initiate, answer, or terminate a call via a single-button press. All necessary dialing, SMS/texting, emailing, or searching must be completed before the vehicle is in motion or while safely parked.
    • If a situation requires handheld interaction (e.g., extensive navigation, urgent messaging, complex calling), the driver must pull over to a safe location (e.g., parking lot, rest stop) and bring the vehicle to a complete stop, engaging the park gear, before using the device.
    • Drivers are responsible for any fines or penalties incurred due to illegal handheld device use
  • Prohibited Activities: Users shall not:
    • Tamper with, disable, or circumvent any security features of the App.
    • Use the App for any illegal activities or to transport illicit materials.
    • Stalk, harass, or harm other users.
    • Reverse engineer or attempt to steal the App’s source code.

5. Data Privacy & Tracking

  • Location Data: You acknowledge and consent that the App tracks the real-time location of Assets and Drivers.
  • Data Usage: The Company collects data to provide services, improve app functionality, and ensure safety.
  • Privacy Policy: Our Privacy Policy describes how we handle your data.

6. INTELLECTUAL PROPERTY

All content, software, logos, and branding on the App are the exclusive property of Cadence Event Management, LLC or its licensors. Users are granted a limited, non-exclusive, non-transferable license to use the app for its intended purpose.

7. LIMITATION OF LIABILITY

  • "As Is" Service: The App is provided "as is" without warranties of any kind.
  • No Guarantee of Accuracy: While we strive for accuracy, the Company does not guarantee that location tracking will be accurate, timely, or uninterrupted.
  • Liability Cap: To the maximum extent permitted by law, Cadence Event Management, LLC, its clients, event volunteers, employees, or officers shall not be liable for any indirect, incidental, special, or consequential damages, including loss of assets, profits, or data, or damage resulting from the use or inability to use the App.
  • Asset Risk: The risk of loss, damage, or theft of assets during transportation remains with the user/customer, not the app provider.

8. TERMINATION

  • Termination by User: You may delete your account at any time.
  • Termination by Company: We reserve the right to suspend or terminate your account at any time for violation of these Terms or for safety reasons.

9. CHANGES TO TERMS

We may update these terms from time to time. Continued use of the app after changes are posted constitutes your acceptance of the new terms.

10. GOVERNING LAW

These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles.
